Whitby West Cliff

Direction under Article 4 in respect of certain development within the curtilage of a dwellinghouse and certain minor operations, In part of West Cliff, Whitby situated within the Whitby Conservation Area.

Whereas the Scarborough Borough Council (hereafter referred to as ‘the council’), being the Local Planning Authority for that part of the Borough of Scarborough which does not fall within the North York Moors National Park, is satisfied that it is expedient that development of the descriptions specified in Schedule I hereto should not be carried out in that part of the area for which it is the Local Planning Authority which is specified in Schedule II hereto and which is delineated and shown edged red on the map annexed hereto unless permission therefor is granted on the application made in that behalf under Part III of the Town and Country Planning Act 1971.

Now therefore the Council, in pursuance of the powers conferred upon it by Article 4(1)(a) of the Town and Country Planning General Development Order 1988.

Schedule 1

  1. Schedule 2, Part 1, Class A – the enlargement, improvement, or other alteration of a dwellinghouse, other than such works carried out at the rear of a dwellinghouse.
  2. Schedule 2, Part 1, Class H – the installation, alteration or replacement of a satellite antenna on a dwellinghouse or within the curtilage of a dwellinghouse other than on an elevation not fronting a highway.
  3. Schedule 3, Part 2, Class A – the erection, construction, maintenance, improvement, or alteration of a gate, fence, wall or other means of enclosure other than in any position which is not between a building and the boundary of the curtilage of that building with a highway.
