Direction under Article 4(1) to which Article 5 applies restricting permitted development relating to solar PV and solar thermal installations on roofs within the Whitby conservation area.
Whereas Scarborough Borough Council being the appropriate local planning authority within the meaning of Article 4(4) of the GDPO is satisfied that it is expedient that the development of the description set out in Part 1 of the Schedule below should not be carried out on the land described in Part 2 of the Schedule below unless planning permission is granted on an application made under Part III of the Town and Country Planning Act 1990 as amended.
Now therefore the said Council in pursuance of the power conferred upon it by Article 4(1) of the Town and Country Planning (General Permitted Development) Order 1995 HEREBY DIRECTS that the permission granted by Article 3 of the said Order shall not apply to development described in Part 1 of the Schedule 1 below on the land described in Part 2 of the Schedule below:

Part 1 – Development
1. The installation, alteration or replacement of solar PV or solar thermal equipment on a roof slope on
- (a) A dwelling house or block of flats
- (b) A building situated within the curtilage of a dwelling house or block of flats
Being development comprised within Class A, Part 40 of Schedule 2 to the said Order and not being development comprised within any other Class.
2. The installation, alteration or replacement of solar PV or solar thermal equipment on a flat roof or a slope of a building other than a dwelling house or a block of flats.
being development comprised within Class A, Part 43 of Schedule 2 to the said Order and not being development comprised within any other Class.
