The Malton and Norton neighbourhood plan was made (adopted) by North Yorkshire Council on 13 November 2024.
The neighbourhood plan now forms part of the statutory development plan for North Yorkshire and its policies will be used to determine applications for planning permission, alongside other development plan policies, in the neighbourhood area.
The plan was prepared by the Malton and Norton on Derwent Town Councils and the neighbourhood area comprises the administrative boundaries of those two parishes.

Updates
November 2024: Neighbourhood Plan Made
Following consideration by the council’s Executive on 5 November, the Malton and Norton Neighbourhood Plan was made (adopted) by Full Council on 13 November 2024.

Referendum
A referendum took place on 3 October 2024. Electors in the Malton and Norton on Derwent parishes were asked:
Do you want North Yorkshire Council to use the Neighbourhood Plan for Malton and Norton on Derwent to help decide on planning applications in the neighbourhood area?
A majority of the votes were cast in favour.

In line with national planning guidance, following the positive result at referendum, the neighbourhood plan has now come into force as part of the statutory development plan and will be used to determine planning applications in the parish.
North Yorkshire Council will now arrange for the plan to be formally ‘made’ (adopted) part of the statutory development plan. Further updates will be added to this page in due course.

Examiner’s report and Regulation 18 decision statement
The examination of the submitted Malton and Norton on Derwent neighbourhood plan took place from 11 December 2023.

The examiner confirms that the submitted neighbourhood plan reflects the views of the community, and subject to the recommended modifications in the report being completed, he is satisfied that:
- having regard to national policies and advice contained in guidance issued by the Secretary of State it is appropriate to make the neighbourhood plan
- the making of the neighbourhood plan contributes to the achievement of sustainable development
- the making of the neighbourhood plan is in general conformity with the strategic policies contained in the development plan for the area of the authority
- the making of the neighbourhood plan does not breach, and is otherwise compatible with, EU obligations
- prescribed conditions are met in relation to the neighbourhood plan and prescribed matters have been complied with in connection with the proposal for the plan
The Malton and Norton neighbourhood plan also complies with the legal requirements set out in paragraph 8(1) of Schedule 4B to the Town and Country Planning Act 1990.
With the modifications in place, the Malton and Norton neighbourhood plan will meet the basic conditions and can proceed to a referendum.
Following the examination and receipt of the examiner’s report, on 16 July 2024, the council’s executive agreed that, as modified (recommended by the examiner in Appendix A of the report), the plan meets basic conditions, can proceed to referendum and that the voting area for the referendum should be the area designated by the former Ryedale District Council on 19 February 2019 (the parishes of Malton and Norton on Derwent).
The council is required to publish a Decision Statement confirming the council’s position on the neighbourhood plan (pdf / 619 KB). The council’s executive agreed to publish the Decision Statement.

The local planning authority is satisfied that the required documents have been provided to meet Regulation 15 of the Neighbourhood Planning (General) Regulations 2012 (as amended). These documents are:
- the proposed neighbourhood development plan
- a map or statement which identifies the area to which the proposed neighbourhood development plan relates
- a consultation statement
- a statement explaining how the proposed neighbourhood development plan meets the requirements of paragraph 8 of Schedule 4B to the Town and Country Planning Act 1990 including a strategic environmental assessment and habitats regulations assessment
In May 2022, the council undertook an initial Regulation 16 consultation after the submission of documents by the Malton and Norton-on-Derwent town councils. However, they later chose to withdraw that submission in order to make amendments to the plan. Those amendments are presented in the documents above.

Regulation 14 consultation
Before submitting a final proposal to the local planning authority, the qualifying body must first publicise the details of its proposals to the wider community. This is known as a Regulation 14 consultation and commenced on 27 January 2023.

Neighbourhood area
Malton and Norton's town councils, as the qualifying body, are working together on a shared neighbourhood plan for their towns. In 2018, they submitted a designation statement to us in order to form a neighbourhood area, the area that will be covered by the neighbourhood plan.
